i wish you best of luck but when i contacted my developer they clearly told me if we ask our money back before completing the payment schedule we have to give penalty of 30% of total amount. its a general rule here.. this penalty is huge. even if we delay payment for 1-2 month they can slap penalty 3% or as per contract. all rules are in their favour.. i am sorry.

BACKGROUND

I bought from a developer called Sweethomes - Project is Ajman Uptown.

I only bought because they were advertising a construction linked payment plan - in the Gulf News, Khaleej Times everywhere. Pay 50% till completion, 25% on handover, and 25% after handover. Unfortunately, after the downpayment, and paying two installments - we got the contract - payment plan is quarterly and no mention about the construction. Now, I have paid 40%, and would even probably walkaway, unfortunately have post dated cheques - which cannot be stopped... Almost Zero construction.... so I need a lawyer, no matter what.

LAW FIRM:

I went to a Law firm in Dubai. With Ajman's existing laws, there is nothing they can do. My contract has no protection - just pay like a fool. Also, post dated cheques cannot be stopped.

The only hope that I have is the "NEW" Ajman property laws. There was a draft law, which is now being being formulated - but not ready for release. I don't think the new law will protect us fully, but if I can at least stop at 50%...as the developer advertised or till construction makes meaningful progress, I would be happy. So in summary, waiting for the new laws.

Current Developer price - 1,400,000
No one is interested at SP of 950,000...... why would they be - 950,000 for a patch...with some very basic construction.

Oh well...Sweet homes indeed.
