
for some reason i dont know why as soon as there is post asking people to take action on issues in Emirates city there is a FLOOD of either FOR SALE units or any other news to distract the investors from reading the post and pushing it to the next page.
These tactics wont work. the investors will be made aware of the truth.
I for one have already gone LEGAL against R HOLDING for my units in EYE tower and awaiting the first hearing.
i encourage all who have their documents in order to pursue their rights. there is LAW and all are bound by it. please understand the court in AJMAN is FEDERAL court of the UAE (not only AJMAN ).

Enough time has been spent and wasted discussing the best solutions to issues in Emirates city projects. I feel all the investors have about reached the stages where either their handover dates has passed or is due in 2010. In both the circumstances it is practically not possible to get your unit with required infrastructure. I feel by not paying the installments already the projects are at standstill at this moment to protect your rights ALL those who can should go LEGAL. that i feel is the BEST solution for getting commitments from developers with COMPENSATION clauses.
At least we will get a clear picture of where are money stands. If it is lost so be it , we will at least be able to move on with our lives.
All Investors who are in UAE start taking initiative look for a good lawyer ask him to prepare case, get your documents ready and then ask them to send a warning legal notice to the developer for proceeding with a case this will cost around less than 1000$ with all the paper work and translation.
If the developer is willing to reach a common ground then fine otherwise proceed towards the case.
ACT NOW. just stopping installments will not get you your money we are just giving them more time to enjoy interest on our monies.

YOU can file a class action if only multiple units are in same name from same developer and same building. otherwise each unit has to be filed under a new case.
ALSO VERY IMPORTANT. PLEASE check in your CONTRACT for a clause called ARBITRATION by an court appointed arbitrator then its a different ball game altogether with no appeals. just a hearing between your attorney and theirs in front of a arbitrator.
ONLY way we can cause any sort of a change by UNITY is like i said in my earlier post all those who CAN and have their papers in order go LEGAL atleast do the ground work , get your papers checked by a lawyer , get your documents translated ( court only understands arabic ). see if your contract has any loopholes in favour of developers like ARBITRATION clause , NO DAMAGES clause , (only principal paid ) etc
ALL in ALL guys just do your homework.
BE UNITED in sharing information, HELP out other investors by guiding them in procedures, HELP them in identifying the cheapest translators etc....that is what unity is to me...and that makes more of SENSE

what is arra going to do with projects & developers which are not register yet? what will happen to such projects investors payments?do they loose their money or the government suport them?

first of all eye tower has changed by 35 % . from 34 floors to 21 floors. the legal opinion for this is that if you are on 21 floor and lower you dont have that strong a case . the contractual obligation states you have bought a unit of a particular size on a particular floor the lawyer says as long as developer is giving you similar specification in your unit it is difficult to prove the presiding judge how you have been at a loss. ( they argue you have bought a unit and not the building ). but if you have bought 22 floor and above you are in extremely good position to get your whole money back plus loss of income 9% pa from date of case starting. plus the court fees of 7 % is also recoverable. because the unit no longer exists.
maybe investors with units on lower floors (below 21) can get to gether share info here on how you can give direction to your case. the maintenance charges can be a good point, date of completion can be a good point also.there is NO chance they will finish this building by 2010.
ONE good thing in your favour is that your contract mentions total gross area as per 34 floors and now the gross area has changed considerably you can argue that this is a new building hence your contract is no longer valid.
BUT one thing is for sure if you dont file a case you will niether get your unit nor your money.
