Residence Visa

Last year I purchased an Apartment in the emirates city, Ajman and now after paying for about 15% the project is delayed, no activity is conducted so far at the project site. And I have heard that there will be no visa with the apartment.

My concern is:

• In case there is no visa with the apartment can we get the money what we have paid them? The sale contract clearly says that the visa will be provided with the apartment

Dear Freind,
Regarding to refund your mony you will find that on your agreement with developer but 10% is deducted if you ask your mony being refund according to normal agreement of EC projects.
About Visa I sould say that I don't think you can find on your agreement that developer is responsible to issue visa, They only would confirm your owning in EC and related office would take decision for issiung.
I don't see that logical to invest your mony somewhere like Emirate for getting permanent visa meanwhile you can do that easier for other better countries like Canada or in Europa.
Anyway don't be upset my freind we all have same situation and we knew that projects would be on delay to handover from first and no reason to complain we have.
I don't know why try to sentence developers everyday meanwhile we knew the projects could not be started until 80% is sold and that may took 6 moth or one year or more then we have to accuse other investers then why did not come to buy project for earlier starting.

Getting a Visa

Getting a visa for Canada is easier than Ajman?!? Really? If that's true then I'm moving there; where can I sign up?

I think what its meant here is that getting visa for Canada and the likes is much more defined in the sense that the requirements are clear and firmly established which do not change. For instance, if you are qualified individual, backed with officially recognised documents, such as a Doctor, a Nurse, etc., etc., with wide experience then it's much easier to get a residence visa in those countries as they need professionals in various fields. Again, if you are an investor and have enough cash and want to invest there, it is much easier and straight forward then elsewhere in the Gulf region because the parameters are clear cut and well established for a long time. That is not so in many of the Gulf states where rules and regulations are subject to frequent changes and modifications by a stroke of a pan. The question of visa, for instance, is a point at hand.

If you want to cancel your

If you want to cancel your contract because of visa issue then you are probably using wrong reason to do so; because your developer is not only not responsible for issuing or not issuing visa, but also cannot even forward a request on your behalf to support your application, until when the property is fully finished, handed over to you, registered and the title deed has been issued. Only then can you claim to have bought a flat. At the moment, you bought a "flat"on a piece of paper which exists only in the minds of you and your developer, based on your MOU - or agreement- but not on the ground, and certainly not in the government records. I am talking here legally, of course.

If on the other hand you want to cancel your contract for the failure of your developer to start building then that is a different issue - from visa issue- and will certainly depend on the details of your contract or agreement with your developer. The two issues must not be linked, at this moment; I mean the visa issue and the delay or lack of progress of the project on the ground.

First of all, before you

First of all, before you think about the VISA ... get your apartment form the developer which may take up to 10 year /or maybe the developer get bankrupcy before you own it.

As Al Andaleeb & I have the contuct that they will give Residence Vissa to us. But they can not do that. It is their fault. They should pay back full amount. As Dubai will cancell all projects that yet not started construction & the will pay full back.

Another fraud is done by Real Estate investment in where they cancelled projects for many people although they did not open any kind of escrow account. Also they did not start construction in any tower in EC project. If you want to argue or discuss with them, they tell u that they are related to the government and there is nothing to woory about. I am getting this response from more than 2 years back and still no construction started.

God plz save us from these developers. They ruined the reputation of ajman in the whole world.

Delay in Costruction and visa for investors

My developer wanted to reschedule payment plans and make changes in the agreement due to so called financial crisis and anticipated delay of at least one year in completion and handover of the building. I refused to do so as I have already paid more than 50% of the unit price and still continueing to pay monthly instalments without delay. The developer has not provided escrow account despite assurance. The reason for delay in construction is not due to financial crisis but because the developers have invested buyers money in other projects out of their greed instead of using it on the same project that money was meant for. Moreover developers are not willing to take risk and pour funds from their own finances to complete the projects as committed. As per agreement the buyer may cancel the cotract but developer will refund the money less 10% only after the resale of the unit .
The developer had promised residence visa on behalf of the Government of Ajman at the time of purchase but the agreement stipulates that the visa is subject to approval of the authorities. The new visa rule is very disapointing for investors in Ajman as there is hardly any property worth a million dirhams. The people invested their hard earned money with confidenec and trust because they felt that their investments and intersts are protected by the government. After the the new discreminatory rule concerning visa and no prtection against the developers violating the agreements I lost that cofidence. Like me, there must be many more who will not trust and will ever think to invest again. Is there any way out or is there anybody in power to listen and provide justice and relief to investors who must have sacrificed the needs of their loved ones for better future ? I hope the government of Ajman would and should take serious notice and neccessary measures to regain the confidence of people if they realy want future developments and progress.
