Petition: Monthly construction status update

I would like to suggest that we, as the investors of Emirates City, demand that all concerned developers provide us with monthly construction status updates, circulated to everyone by email. These updates should describe what progress was made in the past month on each project, what works are planned next and their timelines, explanations for any delays and remedial actions taken, as well address any issues that are being raised by investors (e.g. revised payment plans in light of delays), etc.

So far, the only news we seem to get from the developers concern their newly launched projects, but they provide no feedback at all concerning the projects they already sold to us. In these critical economic times, when less and less people are willing to invest, and more and more people are panicking and trying to sell, I think it would be to the developers' overall advantage to put much more effort into reassuring their existing investors that they know what they are doing and are committed to deliver on their promises. I think that would even have a direct effect on their new sales - in this Internet age, information spreads fast and far; if more existing investors complain in various forums such as this, more new investors will be scared away.

So, I would like to suggest to computer expert(s) among you to volunteer to prepare a petition to all of the developers that the rest of us sign electronically, demanding a monthly construction status update, as described above. Your thoughts, everyone? :)

Have u noticed developers trying to isolate all investors or Endusers, they worry such collective work as what we are trying to work it out!.

I was so excited about creating this petition draft, that I hammered it out in much less time than I thought I would need (a good example for EC developers to follow ;)). I did my best to make it sound constructive and not too confrontational. Everyone, please feel free to suggest additions, deletions, or better phrasing. I suggest that we collect comments for the next 5 days (i.e. through Thursday, 6 November) - this should give everyone ample time to read, think and make suggestions. After this, I will prepare and post a second draft and, if no one expresses any objections to it, will pass it on to our facilitator for further action. I think if we get as many signatures on this petition as there are members on this site, it would be quite difficult for the developers to simply ignore our request.

Messrs. Developers of the Emirates City - Ajman,

We, the undersigned, have invested our money in the Emirates City and wish to bring to your attention the following concerns:

The Emirates City (EC) was launched in mid 2006 and was supposed to be completed by 2010 (ref. R Holdings website). However, to date, out of the 92 planned towers, only X towers have something to show above the ground level, and even these towers have reached at most X floors out of the planned XX floors. Clearly, the planned completion dates will not be met and this is extremely worrying to those of us who planned to live in the Emirates City, as well as those of us who expected to see a return on our investment in terms of rent/sale within a certain number of years.

What raises our concerns even more, in addition to the slow progress of construction, is the lack of information and transparency from the EC developers. None of the EC developers provide regular feedback to their investors, and even ad hoc inquiries from the investors are rarely answered clearly and comprehensively. This uncertainty is leading to the loss of investor confidence in the EC developers and the EC project as a whole.

At this difficult time of global economic crisis, we believe that it is very important for the developers to reassure their investors of the soundness of their decision to invest in the Emirates City. Failure to do so would not only lead to the loss of current investors, but would also create a negative reputation for the EC developers, which in turn would discourage potential new investors and impede the launch of other new projects.

To avert this loss of confidence, we would like to propose that the EC developers provide us, the investors, with a monthly construction progress update, circulated to all by means of an electronic mailing list. This update should describe the construction progress during the previous month for each of the EC towers or tower complexes (e.g. Goldcrest Dreams, Paradise Lake Towers, etc.), the works scheduled for next month, reasons for delays and remedial actions taken, as well as address various issues of specific concern to the investors, such as revised payment plans in light of construction delays, etc.

Such an update would serve several purposes at once:
• keep the current EC investors well informed about the progress of the project and reassure them that their investments are in safe and responsible hands;
• create confidence among potential new investors in the integrity of the EC developers and their ongoing and planned projects;
• relieve the EC developers of the need to respond to numerous ad hoc queries from a multitude of investors who are concerned about the progress of construction and other related issues.

We believe that this proposition would be to the mutual benefit of EC investors and developers alike, and we look forward to receiving your positive response to it.

I think instead of sending this pettion to individual developers, put pressure on the master developer R holding, they have over all responsibillity. it will be better if R holding follow the construction activity in EC and keep us informed by their websit--- that have not been updated for years. Release a copy of petition in the press.

I really praise u for raising the desire of all the buyers. Moreover the buyers who r living nearby can join and visit the developers and request them to pace up the work on site. U guys who will do it willhave duas of others who r far away.

I just wanted to say that I think your petition idea is excellent and the draft petition hits the spot for me. I think that it should be sent to the master developer, with all tower developers copied in.

Overall, I think we need to accept a long delay, but hopefully, the big 'on completion' payments that most of us have to make can be delayed until substantial progress has been made. I need to make mine next July (Goldcrest Dreams 1), but would not expect it to be completed until well after this date.

Dear all, many thanks to everyone who commented on the draft petition, much appreciated. Sisi, I agree that concise and precise is usually better, but in this particular instance I feel we cannot overemphasize our concerns - after all, individual investors have raised them with the developers many times before, with no tangible results. I would really like the developers to feel our worry and pain - even if that means a few redundancies in the text. So, if there are no strong objections to the essense of the draft, I would like to hand it over to our Administrator as the final version for further action. There are a few 'X's there that need to be filled in - I don't know how many towers are already under construction, or how many floors have been built.

Personally, I like Graham's idea of addressing the petition to the master developer, with all tower developers copied in.

Tariq77 also suggested of releasing a copy to the press. I am afraid that might immediately put the developers on the defensive and thus become counterproductive. Instead, let's approach them in good faith and hope they respond likewise. Let's keep the press option for later, in case 'good faith' fails.

Problems of Petition

1. Thanks and sorry for delay in launching Petiton system.
I'll try to launch it during 3 days, Maybe sooner.
2. Just finalize the draft. Hope other friends help to finalizing it. Becuase we can't modify it after begining to gathering signature. Not in technical aspect but in ethical aspect. Maybe someone who sign a petition don't accept/agree to change the body of petition.

3. Also, I think the body of petition should be to no special developer or master developer. It can let us to send it to all developers.
Because we have to mention the tower and even the unit no when we sign the petition and every signer (signatory) have a unit in one tower (which is belong to one developer), Maybe there is a tower which we can gather hust a few signature (i.e. 1, 3 or 10 signatures), It's not enough and it can't force to the developer. The master developer don't do what you want - I think. What should we do for solving this problem?

Just to add my view that I believe Amal is spot on with his comments. This is what we need.

On a side issue I anxiously await the Developer/Constructor review of completion dates as promised by Sweethomes and due in December. I for one bought in may 2006 and have paid over 80% of the full purchase price so far. I would like to think that I shouldn have to pay any more until handover at the earliest. My handover is supposed to be next month...with completion mid 2009.....(dont laugh its not funny).

I am in the same plight as yours I have booked an apartment in tower B8 and have a contract reflecting completion date as Dec 2008 and have made 80% payment so far.
I think we ought to suspend further payment until completion/handover.

R Holding

R Holding is the master developer but technically they are not in the scene. We are paying to Sweet homes not R holding but we got agreement from R Holding! Why like this? Please try to give some light on this.

80% already paid for B8 units!! Thats amazing, considering at what stage the construction is at... :jawdrop:
The construction is hardly at 30 to 35%...

Many people pay 100% even before the construction begins, and why?

Mainly since they dont have to issue 40 checks?
They careless for another 3 years as if they never owned anything.
These are the people who will actually end up making premium because thats when it counts.

International city and Discovery Garden is a good example.
Owners in IC & DG kept barking and arguing why isnt the construction moving!!
Eventually they endedup making 100% ROI and 50K rental for studio only within 5years which were supposed to happen in 3 years.

Even today the areas like IC doesnt have proper parking, roads, water/electricity has severe problems and its always conjested. Let some affordable houses comeup, than IC will go down the drain!.

Residents in IC continues to complain and seems to get worse but with no choice.

Points raised...

My understanding is that R Holdings is owned by the Ajman Government. (Or may well be the Ajman Govt. itself) They are more often than not the master developer in these Ajman projects...and that is why our payments will, one way or another go to R Holdings.

For similar reasons I am confident that this is why Emirates City will ultimately succeed, where other projects have failed, because of the involvement of the Government.
Look at Al Salam city. How many of us considered/ or did invest in that project. I am aware the Government were involved in that fiasco. By comparison EC is a runaway success. The Government needs to produce something for all that they have promised us. The latest construction photos give me greater confidence than at any other time since we hit the panic button....

Having taken off my rose tinted spectacles...has anyone heard any rumours or have any news with regards to the statement from the Master developer( due sometime in December) relating to a new completion date..as this will of course affect all of us who still have outstanding payments.

Regarding the draft - it is final, as far as I am concerned, but other members are most welcome to take over and rewrite it, if they feel it could be phrased better. I'm totally cool with that :)

Regarding who it should be addressed to - as you noted yourself, a petition with just a small number of signatures sent to an individual tower developer would be unlikely to impress anyone. On the other hand, if the petition is addressed to the master developer and hundreds of us sign it, then it would carry significant weight. It would also place responsibility squarely on the shoulders of one particular party - R Holdings (and if Ajman government owns it, or has shares in it, all the better). At the same time, since other developers would receive copies of the petition, they would also be made aware of their role in the problem and their expected contribution towards solving it.

I agree that the petition should be addressed to the master developer signed by the nominated signatory who shall reprsent the other members and attach details of the other members along with their signatures & copy of the same petition should be sent to all the other developers.
