Dear sirs;
I have stopped payment of January to sweethomes and informed them due to delay in completion date , they must re-schedule payment as per as new completion date as we have bout units with 40% finance after completion.
I did not receive any letter from them such as notice or reminder , ... to enforce me to continue the payment.
Can they sell my unit?
Any Idea?
What shall we do in this situation?

I did exactly like you and I recieved (No response), I think what should we do now is positive waiting, as we are happy now without payment, and our legal status is strong as we fullfilled our comittments.
the ball now in thier court, we are carefully watching thier next step

The below is the contents of my letter to them. and also no response from them

I fulfilled my contractual obligations by paid till the 8th installment but you did not fulfill your contractual obligations by handing over the unit on Dec. 08, the rest of the payments shall be after the handing over the propertyas per the following facts:

- Clause No 10 from the contract agreement (The completion date is 1 Dec. 08)
The payment plan which is clearly indicated that the completion date on 1 Dec. 08 and the 9th installment will start after the completion date on 1 Jan. 08, if you want to delay the completion date till Dec. 09, therefore you have to delay our payments also for the same period.
- Your advertising broachers which is clearly shown that 50% of the payments shall be after the completion,
Are you advertising something and not commit with?

In view of the above, I reserved my right to delay the payments starting from the 9th installment

I am waiting their official reply on my letter to be as an official evidance and make case in the court against them.
If they didnot reply so i am reserving my right to delay the payments.

I think this is a comprehensive comments to them, I did almost the same, I suggest that we wait till we see thier action and then we can move together (file a case) as a group of investors

Dear Tuma,
I fully agree with you. We have to move together if it gets worst.
The points raised by Amjad are really in our favor where SH had been advertising for months that 50% payment will be after completion.

i did the same long time

dear all..

i have stopped the payment since long time. more than 5 months now. i did not recieve any comment from the developer for three months. then they called asking why did i stop the payments. i answered that how do you want me to pay while you are not doing your work. are you there only to collect money?? they said some reasons why they are delaying but you know like most of the developers there they dont have any reason which makes sense. and now 2 more months has been spent with no more comments from their side.

ARRA

I have sent two emails to ARRA, sweethomes and now three contacts ar R-Holding as teh info@rholding address does not work.
I have tried to make calls to Arra office (number on the website) since Saturday but there is no answer. Is the ARRA office empty, does anyone actually work there.
I have filed all my correspondance, stating that if I do not hear anything then Apr payment will not happen. I guess with 2 weeks to go, this will be the outcome!

stopping payment

hi all, i bought 2 units in B8 and i had a similar argument with their recovery and claims manager about rescheduling the payment. his response was pay the 3 payments of 1/1/- 1/4 and 1/7 of 2009 and then you can stop payment until handover. i said i need a clear letter of current status and new committed delivery date, and off course no response. we should all stick together in this
