call ARRA, and ask if they really have escrow. If they do have escrow, moving on to the next steps that will avoid investors to be scammed again:
1- ask your developer to revise the payment plan to reflect construction progress and delays.
if they build, you pay, if they are not building, no payment
2- ask your developer to commit to infrastructure work, electricity, etc, all should be listed in your contract.
3- ask your developer to revise the price to reflect 30% reduction keeping up with real estate value in UAE
4- ask your developer to meet with you and explain why they are delaying constructions
Once all that is satisfied, then you consider paying. Otherwise, dont, ARRA rule#1, developer can not revoke contract period.
dont worry about the language they are using to terrorize you. Make sure they build according to what you pay.
if you have paid so far 20%, they need to show 20% of the building. thats the bottom line.

I am 100% agreed with above said suggestion. All developers should follow this rule after opening escrow account and revise all these things

I was UAE last week, sweet homes gave me details of B5 tower and the screw account of this tower. The bank is dubai islamic bank,
I visited and checked with dubai islamic bank and ARRA and they both told me I have the the corect escrow account of B5 and they said after now your payment is safe. I paid my due instalments to the escrew account B5 and I am keeping an eye the constuction till end of 2009 and begining of 2010.
Poor thing
Give it 6 months, you will find out ypur payment is not safe with escrow. Is ARRA managing the account? Ask and find out, get a revised payment plan.

Tuma, I fully agree with you. Not to pay SH anymore till completion as indicated in the Contract and clearly and undoubtedly stated in their ads. Escrow account could be another trap. No need to throw good money after the bad money.

I have not pay sweethomes from my Installment on Jan and till now i have not received any notice from them.As i should pay 40% of amount within 2 years after completion and in other hand the completion date is chnaged from end of 2008 to end of 2009 , i Asked them to reschedule the payment but they refused.
Can they push us to pay installment (which should be paied after completion) before ?

dont pay until you clear all your concerns with them.
1- revised payment plan that connects your payment to construction progress
2- any penalties you want to impose for the delays
3- electricity gurantees
you need to be convinced they will deliver.
Payment after completion
How can the developer ask for payments before completion of construction, when those payments were meant to be paid after the completion of the tower? In this way slowly they can grab all our hard earned money, and tell us to forget about our original payment plans. Based on my personal experiences on individual basis, I am afraid that once they have got all the money they will not listen to the investor even if the investors beg their rights. We remember the initial days when we were booking our apartments how pleasantly the developers were talking to us. Once they got few installments their behaviour started changing and they stopped responding positively anymore.

A contract is an agreement by BOTH Parties to adhere to. I have met my agreements, until the LAW of UAE intervened (ARRA). YOU have NOT provided me with my completed apartment.
I respectfully request that you adopt a payment schedule linked to construction like and come back to me with an appropriate payment plan if you WANT payment on time for JULY 09.

I told the DHL guy that I dont want to recieve this. They are now sending out new contract where it is stated Thayt the buyer ( I ) will start paying the rest. Dear brothers they are now desperate after money, DO NOT PAY ANY MORE , THE CONTACTS IS CLEAR REST 50 % AFTER HANDED OVER. They will not find any new buyers for these projects, So lets gets together brothers and stop paying , to show that we have the power. Do not sign any new contract from SWEET HOMES DUBAI for paradise lake tower. This is FRAUD. We have signed one contract and that is enough. I personally stopped payment from January and they have not send me a notice letter for payment or interest as i informed them that 50% of total amount was after 2008 and it was schedule according to completion date of Dec.2008.
I asked them to change the schedule payment but they insist to get money and have not change the payment terms yet.
I really worry with these cheater developers.
Instead of paying penalty to us due to falling price&delay , they asked us to pay installment of after completion before it.
It is really a good response to loyal & fool investors like us.

I stopped my instalment to sweethomes since Dec 2008. At the beginning of this year they sent me e-mails to pay with penalty charge. I replayed to them you have to pay a compensation to me first because delaying of construction and cheating us in newspaper when we purchaced our apartments the completion date was Dec 2008. I told them I will go to court if you ask for any instalment until completion. Then they stopped sending me any e-mail. So don’t pay them any instalment till completion if you paid more then 40%.

coming from either overseas or local buyers will all reflect into this Dubai
Islamic Bank, Sweet Homes Escrow accounts in which the details are below.

With all the payments you should have received upto now, you should have enough money to have completed the towers. Afterall, the payment plan would have been designed to factor this in ie 40% of payments and you get your tower ready to move in!! the rest of the payments are due after completion and handover as per your contract, media circulation, web advertisments etc...
Therefore are you saying that you have NO money left to complete the towers? Have you run out of money for construction?
The rest of the money was due after completion, so why now do you say that FUNDS ARE REQUIRED TO SUSTAIN THE DELIVERY?
What have you done with all our investor money that we have paid up to now??

How am I supposed to live there if these amenities will not be ready? You have 6 months to complete all this - this is NOT realistic by any stretch of the imagination.
Please explain how you can expect me to pay as per the original schedule when you have not stuck to your end of the agreement.
Your case for requesting payment is still not valid considering I have made payments as requested and am still watching my tower at 3rd level.
If it was B8 tower at say 21st floor, there may a possibility that the would be ready, but what of infrastructure? Please advise status of power station, water, lighting, gardens, schooling, mosque and shopping mall, etc...

Nads: Thank you for sharing. I think for far too long, we've been battling these guys one by one....and each one of us gets a story and a run around. The more we can compare notes, the more empowered we'll be in our arguments.
One big divide between buyers is - those that have issued PDC's and those that have not. Anyone with PDC's outstanding is getting shafted twice - by the rogue developer - cashing cheques at will - and another by the letter of the law if we don't honor the cheques.
In our case, they don't even want to, or have to explain. Any time they need money, they just cash another cheque !
So on behalf of those of us who've issued PDC's please keep the pressure on and make them work for each installment ...... Maybe time for us to cc the press, contact our embassies, contact the UAE embassy in our home countries etc. All of it may be too late for each of us, but at least it may lead to a change in these rogue practices....and keep other innocent buyers from falling into the same trap.

If we have any UK based buyers - since Sweethomes has a UK office - and some UK agencies may be worth complaining to. For a start - UK Truth in Advertising laws had to have been violated.
Also wonder if writing to the Municipality, Land Dept &/or Ruler's Court will help. They all seem to have websites / contact info. Just some ideas.
