i have bought 2bed room from start giga,gold crest dream.i have stop pying them late 2008.but they still got 1/3 of the money for that project.i have spoken to them as late as two days ago,they have promise to start the project in one month and have,and they will finish ass early as 2012 december.my question to dear buyers,who are they fooling.i have told them finish project with water,electricty and disqaunt from the original money,nothing less or more.every and each one of us should demand this deal other wise we are screwed.if this peaple wher living up here canada they would never see the day light.now you should know that is why we are losing avery war against the kufar.they are batter to the take care the poor people saving.look murdock he is in prison while this guys living high.i can go all night .keep hope alive .

Star Giga has promised "to start the project in one month" for over 3 years now. I can't believe they are still coming up with this nonsense. I told them 2 years ago, that they will never restart this project again, because it was simple not a viable business move.
No, forget about it, THEY WILL NOT START this project any time soon. The project will just lay there and rot away with time.

these words have been ringing bells for some times now, I have decided since a year now not to look fo any updates or any news emerging, but some times some how I come acrosse news that is broken about emirates real estates markets and so I come back and visi this forum.

my dear frinds, this projec has gone badly wrong. only allah knows best how it will unfold. there are two things yo can do, most people come here regularly and get more and more upset as there is no news comming from any source exept bloggers cry out. or you can lay this behind and move forward but at the same time keeping hoping any break through.

insha allah we will see justice and we will get our investements back.

GCD Status

I am new to this forum. My understanding as per my discussion with Star GIGA is that this project is scraped. They are only playing with words either to get more money or to cancell the existing contracts without refund.
Their plan, it seems is to cancell the existing contracts of GCD1 without refund and then moved investors from GCD2/3 to GCD1 and ask for more payment. Following non-payment cancell agaiin and repeat the cycle untill with passage of time, the situation dies off.
ARRA is an authority and not without any legal powers which lie with ajman rulers and the court still I am not sure how could they make decisions which are not as part of legal contract signed between developer and the investor. ( I am not sure ARRA has the authority to change the terms & conditions of the contract inclduing the delivery time or void cancellation conditions as documented in the contract.

sorry i forget to mention one ather thing,start giga staff,arra will approve 17 project and goldcrest dream1 i s one of it.
the banks will finance they real sound very sure this time.but i told them rest assure they will not see penny of my money
till they finish this project.with water electricity and so on.my question to my fellews owners is,are they telling this to you too.

Diin, not sure how you got above information, but I would not trust them. Possibly this might be one more scenario they would to test out to bring me investors to pay.
As far as I know, No investors of GCD1 is paying any installments or have paid any money aganist their threatening reminders. They have send cancellation without refund letter, I am one the investors who has received this letter in September.
One more possibility would be that they would arrange for bank loan in the investors name and grab more money, this time the money is paid by the bank but on account of investor. The investor will still be the loser as he has to re-pay it back the bank loan on agreed schedule even if there is no progress or the project is stalled or not handed over the investor.

Considering the original 5 yearly payment plan of start giga, most of the investors have already paid over 90% of the amount due during construction stage and the remaining was developers loan due after handover of the unit in easy installments.

Solly, absolutely agree with you with exception to forget about the money we have already paid to the crooks. We have signed a contract and since the developer failed to full fill the contractual conditions incluing handover latest by 31.07.2011 (for GCD1 delay exceeding more than two years), the investor should have legal right to get his money back.
I am not sure what kind of rules are followed in ajman, but by all respect rule of law should be followed? Based on my experience with GCD, ajman, I would never again even hink of any investment in Ajman or any part of UAE as it seems the law is not very effective.

my fellow golddream buyers we have to look in to plan B,here is the situation.start giga will not refund the money and they are not building right now,that is the reality.we have the upperhand right now and we are not taken advantage. what we got to lose. if we propose all of us at once.we will work with you if you can only sign understanding agreement with this steps

1)price reduction.comparing the real estate on the ground right now before 2012.reason bieng the world is changing the price my go down even more so take advantage of this startgiga we are on the same boat.

2)send every buyer apolagy saying we are sorry sending you a canceletion letter.beacuase the matter is startgiga did not fullfill their end of the contract 2009 july hand over "STARTGIGA FAIL"2011 JULY"STARTGIGA FAIL"

3)we will only pay you the full amount,when you hand over the key with electricity,water and so on.

I plan to ajman and make a complain aganist the deveoper start GIGA with ARRA. Can any one help and let me know what documents are required to be submitted with the application so that I can prepare before hand.

Did any one else get cancellation letter of GCD1 from Star GIGA. I plan to fly over to UAE and make a complain with ARRA as well as look at the options to file a law suit aganist them.
If any one is interested, please do let me know and we can make our travel plans accordingly.

Refund of Investments

Dear ACE, your post sounds very interesting but misses below details which would of interest to investors:
1.0 Your contact details & address where you can be reached.
2.0 Your experience with similar law suits with decision in favor of investor
3.0 Based on Court Decision, how any investors have actually got their investment refunded ( I mean got their money back in their account)
4.0 Initial cost involved to file a law suit OR No initial cost & you would deal with % of recovered money on refund.
I am interested to file a law suit against Star GIGA for refund of my investment in GCD1 (AED 360,000) and against AA property for Ajman Boulevard (AED 285,000).
I can not afford to pay any more until I recover my investment and would be glad to pay you 50% of the amount I get as refund which works out to be AED: 322,500.
Let me know if you are interested to take it up.

We are already in the possession of the cases similar to yours and in all the cases the execution is proceeding smoothly. Above all, the developers is a well-known in the region and has assets to be disposed of in order to satisfy the judgment(s).

Kindly be informed that we are proceeding against the Developers on the basis of U.A.E. Federal Law No. 13 of 2008 and U.A.E. Federal Law No. 9 of 2009 in regards to the Developer’s breach and a claim for a full refund of your payments made towards the Property if there was a delay in the handover of the properties or delayed/absent construction.

Regarding the fees, we charge 5% in Adnave and 5% on Settlement (After you receive all your paid amount) of the claim amount, and all official court fees should be paid by the client.

As you are already aware that GCD1 was committed as per contract to be handed over or before July'2009 and Ajman Boulevard by Dec'2011. Both of this projects fall under delay in the handover of the properties or delayed/absent construction asmentioned by your above. The cost aspect given in your reply is not clear, I would be interested to know how much it would cost me to file a law suit including the court fees and what sort of assurance would you provide to ensure that the additional cost (amount spend) paid in court fees/your fees will be refunded if the decision is not in the investors favour.

I woule be traveling to UAE shortly and would prefer to meet you in person and discuss the options/cost impact before even spending a single cent more as I personally do not trust and belive that laws are followed in terns of contractual obligations, rather it seems like old jungle days when the king of the jungle decides (not the court)

It is surprising that "saY" a lawyer like ACE who made a post does not want to disclose his office/contact details. After all, you can not run a business without registeration to operate and offcourse an office where your customers / potential customers can approach you. You would normally not close a deal in forum like this without meeting the concerns persons/owners.
I feel that ACE is just joking with investors like us who are already very stressed out with their investment with crooks of ajman.

I have been saying this for a long time. we also just come out here, dish out our frustation on the forum .

Why don't we all get together. Get a written document and file a joint case against these guys. What is there to lose???

Lets make it very clear to any ACE or anyone. We will pay more than what u ask. Gives us results and we will make an agreement with you . There are so many of us that you don't need to work for your rest of you life with the money you receive as your commission. But first prove youself. We know a lot like you "ACE" who can talk all day long but cannot move a stone when it come to legal aspect.

Please post your numbers for all GDC1, GDC2, GDC3 and GDC4. Can anyone make a facebook page for GDC it will help . We can get all member there.
