That is the mistake your doing.. contacting firms. You should have looked or tired for friends who have relatives as lawyers or have law agencies in UAE.

An agreement would be made. I am still waiting for feedbacks.

It's simple way of thinking. X no of investers pay 8 - 10% of property value once they receive the money if the case is legimate. for the lawyer it more than what he can earn in 1 year.

My assumption is that even ARRA will not publish the true list of EC projects which are already unoffically cancelled and/or it is well known to them that this project will never be built/completed in near future.
Publishing on the website is just whitewash to make investors pay installments and then subject them to cancellation due to failure to pay without refund of investors money.
This is exactly what they have done for GCD1, they did not respect the terms and conditions of the contract (long stop date of 31.07.2011 after completion of delay of over 2 yrs) and send termination notices without refund to investors.
The legal framework does not really exist in Ajman, so to take them to courts would be more waste of good money to recover the bad money unless we have an alternate solution as proposed above. I am not sure how much would be the court fees which offcourse needs to be paid beforehand.
You could easly imagine the influence / contacts of developers wth the ruling family by looking at the wedding pictures of one of the directors of sweet homes.

GDC-Crook I do not disagree to any of the facts you have mentioned. Yes they have a very strong hold. We are all aware of it. I am taking a difference route with them . I don't want to mention it here. They read these forums daily. I have your emails. I will confirm and respond if we have a good chance. I will not post anything here. Some of them are users as well.

The simple reason why they have support. Emirates City will surely be built, work might start in late 2013. With infrastruction being laid, just in time for 2015 utility service commencing in that zone . If they pay you back who will Pay them to build.

Ajman Boulevard fraud

I flew over to UAE and registered my complain with ARRA yesterday. After meeting the representatives from ARRA, I am not expecting any positive solution.
Their advise is to swap with projects which are at advance stage of construction with same payment condition/price which I guess no one would agree with considering the current situation. Also the Ajman Boulevard project is dead and even emirates city is deserted place without any construction activity.
No hope at all, the only option is to try to get our investment back.
My advise, please do not pay them any more, the more you pay the more you will lose. It is not worth to put in any good money to recover the dead one.

Has any one who has received termination notice from Star GIGA and made a complain to ARRA received any response?
If the rule of ajman is that no one can cancell without obtaining approval from ARRA, I fail to understand how could star GIGA sent termination notice wihtout ARRA approvals and no action is taken by ARRA. Seems like double standards for investors and developers.

@gcd crook: as far as i know star giga is not a small developer and i dont think they will runaway! they already have many bldgs in dubai ( 3 or 4 bldg @ JLT & i think in marina too). also, they are partner with al ghurair ( one of the big and old group of companies in uae). i also heard they have giga gold refinery and textile factory, etc....

Giga to hand over 1,000 units in JLT
Mazyood Giga International and ETA Star Property Developers together, under the joint venture enterprise, Star GIGA Establishment, will hand over more than 1,000 units in its two projects, Goldcrest Executive and Goldcrest Views 2, in Jumeirah Lakes Towers (JLT) community, during the year. Goldcrest Executive is a 39-storey tower consisting of 229 office units, 183 studios and 141 one-bed apartments. The tower offers half a million square feet of built-up space, basement retail areas, a plaza, business centre and a first-floor suite of meeting rooms. Star Giga Establishment, admitted that there was a "slight" delay in completion of the project but was happy with the infrastructure at JLT. All investors had been compensated as per contract terms for the delay. More than 100 apartments had been leased out in Goldcrest Executive tower with rentals for studio apartments starting from Dh50,000 per year and from Dh70,000 for single-bedroom apartments. In September 2009, Ahmed bin Sulayem, Executive Chairman, Dubai Multi Commodities Centre (DMCC), told this newspaper that 35 towers had received building completion certificates and that this number was expected to reach 50 by year-end. "This figure will go up to 70 by the end of 2010. And then by another 10 or so by the year 2011 or maybe in early 2012," he had said. Regarding maintenance charges, Giga said they had got approval from the Real Estate Regulatory Agency to charge Dh12 per square foot as maintenance fees. Asked about Star Giga's plans to launch new projects in Dubai, the company was currently emphasizing on completing on-going projects and new ones would be announced subject to market conditions.

Let me be very clear ... ARRA is for the support the DEVELOPER and safe guarding these developers.

I have tried so many option to get some support from ARRA but they are in full support of the developers.

the clauses in the contract are some what nulled as there is a new policy set by ARRA. So this sad part of story .

I will try till the time I can . REFUND RECOVERY GROUP is a good idea .. i am in ..

Refund recovery group

You have about 25 people ready for some action. Each person puts 3000 dhs and you file a court case.
Filling fees are %7.5 of the contract value with max. of 30000 dhs.I believe it is the only way to get your money back.Since star giga office is located in dubai,the case can be filled in dubai courts as well.

My whole mentality is to stand up for your rights and fight for justice.Even if you have invested very little money on these projects,you can't just walk away and let these crooks spend your money....

Please use some common sense - you contracts are governed by Ajman Law Courts so you will not be able to take your case as a class action through the Dubai Courts.

I have researched for a year as to the best way forward. I have spoken to some of the best lawyers in UAE. The answer is £8,500 or thereabouts legal costs in order to recover 150,000 dirhams. Its simple but who has a spare 8k to throw away.....

Can property investors in one emirate file case against a developer in other emirates? For example, can a property developer from Dubai, building a project in Ajman, be sued in Dubai or Abu Dhabi?

Yes, under certain circumstances, property investors in one emirate can file a legal case against a developer in a different emirate. They can do so in the following scenarios. One, the underlying sales contract was signed in the emirate where the investor wants to bring a law suit. So, for example, an investor in a property in Abu Dhabi who signed the contract for that property in Dubai can bring a suit in Dubai on the basis of the place of the signing of the contract. This applies even if the Developer is based exclusively in Abu Dhabi. Two, the developer has an office or physical presence in the emirate where an investor wants to file suit, even if it involves the property in another emirate. Thus, an investor in a property in Ajman who invested with a developer located in Dubai can also file a legal action against that developer in Dubai, on the basis of the developer’s business residence.
