Does anyone has information about Gold Crest Dreams 1 's escrow account? ETS STAR promised that they would open escrow account by January 2010 end . I'm afraid like always they have again lie to us .
All, I have received an email from ARRA which says that Goldcrest Dreams / Star GIGA is not registered with ARRA.
According to my understanding, they can not operate in Ajman as a developer untill they are registered. Further, the Force major clause in the contract gives you an option, if you see that the project is being delayed over 2 years (which is the case of GCD) from the comletion date which is 31.07.2009, then the buyer has the option to cancel the contract and ask for full refund. I tried to talk with Star GIGA but they do not respond, since I am not a UAE resident, I can not go their office personally and inquire about this option.
If any one of you is a UAE resident, please help and visit their office and inquire about the contract cancellation/refund of the amount paid.

The force major clause also mentions that in the event of force major, a delay of over 2 years is FORSEEN, the seller may cancell the contract and/or the buyer has the option to cancel the contract and entitled for full refund (The clause no.is 16).

I HAVE STOPPED MAKING ANY FURTHER PAYMENTS, I GOT MYSELF A SOLICITOR FROM DUBAI (A UK LAW FIRM AS RECOMMENDED BY BRITISH EMBASSY) TO TRY AND GET REFUND FROM THIS COMPANY BUT WE HAVE BEEN UNSUCCESSFULL. MY SOLICITOR'S ADVICE IS JUST WAIT AND SEE AS THERE IS NOTHING WE CAN DO AT THE MOMENT. THERE ARE 1000'S OF CASES LIKE OURS OUT THERE AND THERE IS NOTHING WE CAN DO. THEIR LEGAL SYSTEM IS SO COMPLICATED AND BASICALLY FOREIGN PEOPLE HAVE NO RIGHTS. IF YOU TRY TO PERSUE THEM YOU COULD END UP PAYING A LOT OF FEES AND STILL MAY NOT WIN YOUR CASE.

Dear Shibin,
It was nice talking to you this morning, and surprised to know that you are unaware of most of the agreement details. You told me that the completion date of the project is not mentioned anywhere in the contract. Please take a careful look at the attached contract page, where I circled in red, the completion expected date, which was supposed to be by 31 July 2009 and the long stop was supposed to be by 31 Jan 2010.
At the time of handing over (July 31, 2009 or 31 Jan 2010) I was supposed to pay Dhs.55,000/-. Now the building is not even completed 25%.and I don’t have to pay anything until the building is ready. When the building is ready with infrastructure, electricity and water (fit for human living), then I will pay another Dhs.64,000/- and the rest will be paid in two years installment, as mentioned in the contract.
So, please Shibin, discuss with ARRA and explain them the way you made contract between your company and your customers and modify them the same way as per the original contract, otherwise nobody is going to pay, according to your new payment terms, which is not agreed by any of your customers.
Please proceed with construction, without asking for money, and regain confidence of your customers,
