CHEATED BY CHAPAL DEVELOPERS
I purchased a property in Emirates City from Chapal Developers. I paid the reservation amount and 10% of the total amount of the property. Due unforseen financial circumstances I could not continue payments so , I applied for cancellation. As per the Reservation form , which I signed if I cancel the flat the reservation amount is forfeited. When i approached the developer to refund the remaining amount he refused to do that as per the contract 20% of the total amount is forfeited in case of cancellations. But my question is that I HAVE NOT SIGNED any contract as yet with them still they refuse to refund.The only document I have signed with them is the reservation form.
I belong to a middle class family - invested all my savings of 10years.
CAN SOMEONE GUIDE ME SOME REMEDY TO GET THIS REFUND.

manish me too having same situation with chapal. i also booked a apartment in chapal the presidency already paid upto40% until jan09. then stoped further payment agreed with the developers until the construction is resume..now i am just fedup and want to get rid from this . but they disagree to refund. i am planing to visit their office this month end . i am resident of uae . lets c together what we can do to get back our funds. my cell no is 0559030084 ring me up. thank you

Hey Akash - its really sad and disapponting on your story as well.
I too visited their Sheikh Zayed Road Office , sent them so many letters - but they are not willing to refund at all. I spoke to some lawyers who are in a view that i can file a case. Before filing case they can send them official notices - but all of these will need expenses of minimum 5000 Dhs may rise more if goes to the court.
I think we need to make a group and approach them. Do you know any other investors who are dealing with Chapal and in the same situation like us.
Meantime i am working on an email to Gulf News who can publish our story and will intervene.

Another victim of Chapal Builders in Ajman
Dear Manish/Akash and everyone else,
I am also being cheated by Chapal.
1) I bought 2 bed 540,000 AED at pre-launch of Corals in Emirates Lake Towers. Paid more than 247,000 AED regularly with no delays. Nothing constructed till November 2009.
2) Visited them and discussed the status in Nov 2009, they offered me Chapal Harmony 1 Bed with 430,000 AED price with positive prospects for future once more. they sounded very positive since there were already six parking floors under construction. I had no choice, they transfered my funds to Screwup (Escrow) account. asked them to transfer funds to any of their property in Karachi but they simply refused.
They sent me contract to sign this property, I refused and asked for revised T&Cs with construction based payment plan. They did not get back to me for last many months.
3) Went now in Jan 2011 at site, construction is still at sixth parking floor.

Dear all,
Same case here. However, there is nothing we can do to get our hard earned money back. They don’t have money to give us back even if they want to. They had already invested our money in to other projects which nobody would be interested to buy. Going to court is a very expensive option with no chance to get anything as you will be going against a very strong team of professionals.

An Update, Chapal sent notice...(they should be shameful)
I recently received a letter and email communication from Chapal warning me about cancellation of property if I fail to resume my payments.
My Question:
Payments for what? There is no progress on the ground. I took a day off to see activities in a normal working day and believe me it looked like it is a ghost town.
I have lost hope on this project.

I tried to find the website left short cut menu, but there seems to be no option for posting a new forum. Also the emiratescity website was out of the internet for few weeks. Did somebody tried to stop the growing power of the investors through this public media?

Any update from CHapal, i have 2 bed in the presedency ... stopped paying since feb 2009, cancel the agreement, they told me to refund if they find any investor to buy my unit minus $10000 worth AED as penalties!!

i bought not 1 but 2 flats in the destiny dubai sports city and this was their main development and in more than 4.5 yrs it has just come upto 1st floor,so with this progress 20yrs more at least,lol.
i paid 84% AS AND WHEN ASKED AS PER MY CONTRACT.
when i visited their office last oct 10 they agreed to waive completion payment of 14% and gave me new contracts with completion date mid 2014.
i consulted more than 2 big comp of lawyers including tamim.
all were of opinion of basically negotiating with them as best option.
costs are exorbitant and no guarantees,i was told by them that judges were giving judgements in favour of builders generally.
so unless we collectively approach the uae govermnent forget it.

Chapal project as totally dead
Hi Emirates City Investors,
I have also invested in Chapal The Presidency Project unfortunately. I visited Dubai and Ajman two weeks back and went to Emirates City as well.
So, just to give you an update that we all should forget about our investments now as Emirates City is totally dead. There is no construction going on. Especially with Chapal Group they have stopped the construction of all of their project. I also spoke to their security personnel at the site and he told me they have started pulling out all the rented construction equipments.
I took lots of photographs showing the dead Emirates City, which I am going to put in my next post. I also secretly took the video of the Security guard in which he is explaining about dead construction status.
So if that is a single percent hope you have that one day you will get your apartment in Emirates City, then leave this hope and lets grab bloody Chapal Group to get some pennies of our hard earned money out of their pockets.
