Chapal Project - constuction totally stopped

Hi Emirates City Investors,

I have also invested in Chapal The Presidency Project unfortunately and visited Dubai and Ajman two weeks back and went to Emirates City as well.

So, just to give you an update that we all should forget about our investments now as Emirates City is totally dead. There is no construction going on. Especially with Chapal Group they have stopped the construction of all of their project. I also spoke to their security personnel at the site and he told me they have started pulling out all the rented construction equipments.

I took lots of photographs showing the dead Emirates City, which I am going to put in my next post. I also secretly took the video of the Security guard in which he is explaining about dead construction status.

So if there is a single percent hope you have that one day you will get your apartment in Emirates City, then leave this hope and lets grab bloody Chapal Group to get some pennies of our hard earned money out of their pockets.

So would potentially find out something from Arra as well as to what action we should take now..

If you are physically located in UAE, is it possible for you to complain to ARRA about Chapal and find out what is the way forward now that they have stopped the constrution?

I am sure they will start putting 3 or 4 guys on site just to take pictures and

EMIRATES CITY PROJECT IS DEAD

My assumption is that even ARRA will not publish the true list of EC projects which are already unoffically cancelled and/or it is well known to them that this project will never be built/completed in near future.
Publishing on the website is just whitewash to make investors pay installments and then subject them to cancellation due to failure to pay without refund of investors money.
This is exactly what they have done for GCD1, they did not respect the terms and conditions of the contract and send termination notices without refund.
The legal framework does not really exist in Ajman, so to take them to courts would be more waste of good money to recover the bad money.
You could easly imagine the influence / contacts of developers wth the ruling family by looking at the wedding pictures of one of the directors of sweet homes.

No reply from Chapal

I have invested a big money on Chapal the Legacy. Paid 58% so far. I tried to email them several times but no reply by now after couple of weeks. Has anybody have any connection in Chapal to ask some questions?

I would suggest that Chapal investors who are physically located in UAE must take some actions like visiting Chapal office or going to Arra and asking them why Chapal has stopped construction and what is going to happen with our money.

I don’t understand why we all are so quite and scared and not taking any action. If I was physically there I would be going to there office every week until these bastards not return my money. Come on guys its our hard earned saving which we saved for our and our kids future. We should not let it go like that.

So all Chapal investor in UAE please get together guys and do something.

Investors in Abu Dhabi’s Tameer Towers plan to push ahead with legal action next month, despite the developer announcing work will restart by the first quarter of 2012.

“Based on the current situation and information available, Tameer anticipates delivery of phase one of Tameer Towers to be in the fourth quarter of 2013. The anticipated construction phase one restart is planned for the first quarter of 2012,” a senior Tameer official told Arabian Business’ sister publication Construction Week on Sunday.

Despite this, up to 65 buyers in the Al Reem Island project plan to push ahead with their plan to pursue arbitration against developer Tameer Holding Investment.

“Next month we are going to start our legal case in the arbitration centre in Abu Dhabi,” Thabit Al Temimi, a legal adviser with the Abu Dhabi based law firm, House of Justice, whose clients have invested in the project, confirmed on Monday.

The original delivery date for the towers was scheduled for June 2011, with a clause allowing a six month delay to December. With Tower A having reached only level 13 and Tower B at level 4, the December deadline will now be impossible to meet.

“[By] December 2011, legally, Tameer should deliver the whole project… Even if they start construction, it means nothing. My clients on the 40th floor cannot live in their apartment if it doesn’t exist,” Al Temimi told Arabian Business last month.

I would like to know how many chapal presidency investors are willing to file a court case for refund.

10 investors each puts 6000 dhs. We file a case. After winning the rest of refunds can easily be negotiated from the losers. To me it seems to be the best way of getting our money back.
According to the contract, we should be getting our apartments as of Jan 1 2012.

ARRA LIst of Cancelled EMIRATES CITY PROJECTs

I am not sure what kind of law they follow in UAE (Ajman). Is it the terms & conditions signed in contract (SPA) by both developer & purchaser?
If it is the contract, does ARRA still need to publish a list of cancelled projects as a pre-requisite? 2012 starts from tomorrow and so far ARRA has not publised the list of cancelled EC projects, & my feelong is that ARRA will not publish the true list of EC projects which are already unoffically cancelled and/or it is well known to them that this project will never be built/completed in near future.
Lets wait for couple of more days to see if ARRA keeps in words of publishing the list of cancelled projects, the investors are doomed and desperate to get the refund of what ever is still remaining in ESCROW account.

Useless Arra

‘The most we can do is have them file a complaint and then we can try to get the developer to make the best offer possible,’ said Nael Al Amir, spokesperson for ARRA. Investors will have to seek legal action against developers to secure a refund, he added.>

So the only option for us is to go to the legal system.

Chapal Glory investment

Apparently, we have invested in Chapal Glory, a tower planned to be built in Emirates City, Ajman. We have paid over 70% of the installments, but apparently according to the developer, the project is now on hold, and there are no plans to re-start it anytime in the future.

Our contract will expire in June 2012, and hence, we have approached ARRA, and registered a complaint.

ARRA has responded, and since we have already paid a lot of money, they advised us to go to dubai or ajman court. The developer has offered us different projects to swap with but with very high prices we cannot afford.

I am seeking legal guidance.
