cant we work togather? atleast for one law suite?
as i mentioned earlier also, law is our side we just need to press law enforcement agencies, we have contract signed by developers and clauses are very clear on completion terms. cant we come togather and contribute towards just a single law suite against goldcrest who allready admitted in writing that their project is delayed for atleast 2 years which clear cut against their contract and they must either give us intrest on money received from us or offer to cancel contract and return our money...
how much expneses? may be 10k aed? or 30k aed? ( i am asking because i am not in uae and dont konw much about charges ) even 50k aed, and 10 investors contribute its not a big amount to contribute.. let us go for just 1 case against those developers and let their true faces come in light let us see what law agencies are doing and how they respond... they can not deny our rights..we just need to come togather and try to get justice, their is not much to give as small contribution.. against lots of frustration we are feeling by sitting calmly

I don't know the background of your project - but the court filing fees are - around 30,000AED per filing. This I understand can be recovered if you win.
There are no group cases in the UAE - so if there are 5 properties/5 buyers each one needs to file their own case. Alternatively 5 people can contribute to one case....
Lawyers fees - approx US$400/hr... dependent on the lawyer + so figure on 50-80,000 Dirhams (maybe more) by the time you hear a verdict. In some cases, you can recover your legal fees as well - if you win.
So, you'll have to pay the filing fees...5 times, but I am sure you can negotiate with the lawyer to split their charges - since much of the work will be re-used. Hope this helps.
I agree without lawyers, without the court system - no developer is going to take us seriously. In my case, the lawyer wrote a letter to stop cashing Post Dated cheques - under threat of litigation - and within 2 days there was a response from the developer. This after we had visited them dozens of times and achieved nothing.
The lawyers also told me that they thought we had sufficent grounds against the for misrepresentation / truth in advertising - but no guarantee of a win. Given the 80K Dirhams just to start - I decided to not pursue that for now..... but I agree with you, just sitting around - means being led like lambs to the slaughter.

ok i understand now.. getting justice is too costly.. and its totally in favour of developers. so for me this is land of no justice...anyways, i will still try to find out a reasonable lawyer, is there any lawyer in us invstors??

I fully agree with you. Lets say even 10 or 20 people contribute to one case. If the case goes in favor of the investor it will serve as a precedent for the others. Moreover it will (should) bring the developers to their senses.
I also gather from newspapers that British Nationals have brought the Dubai property debacle (fiasco) to the attention of 10 Downing street.
I also pray for the recovery of our investment.

First of all, I appreciate all of your interest to defend ourself. As everybody is aware that the delay of 2 years is not justifiable.
Before making a legal suite against the Developer, I suggest that we (whoever invested in GC Dreams) will go together and talk with the developer (StarGiga) for the delay. Let us put in another way that We (all the investors who is available in UAE & able to join their hands / supports) will arrange for a meeting & let us raise our issues and rights and put them all in a list and fix up a date for the meeting with the developer.
To Summerise (if you agree for this) :
Stage # 1 : Give your details (your name, mobile No. GC Tower No. & Unit No.) if you are attending this meeting.
(Investos who are not in UAE, can assign your representative to attend this meeting & raise your voice)
Stage # 2 : Once we got the name list & fix up a meeting at a designated place (will be annonced later)
Stage # 3 : Agenda of our meeting : Discuss the issues / rights & Prepare them for raising with the developer
Stage # 4 : Meet & negotiate with the developer.
Stage # 5 : If this is not work out, we can discuss about the legal suit.

Talking to them in a group is a positive step. But these are devious people, they will make promised and send you home with a hope. Best is to submit your concerns in writing across the table, get them to sign and receive on a copy. Ask for a written response and committments/promises made. Before even talking to them, check on their status with ARRA. Does the developer have registration with ARRA, and an escrow account...
Everything they claim, must be verified with evidence.

Can some one give me the most up to date status regarding this tower.
Is the construction continuing ?
Is Star Giga the developers registered with ARRA ?
Do they have an ascrow account?
I do not see their name on the recently realeased list of ARRA approved projects.
I have received a letter from Star Giga setting out the new payment plan which is attached to the stage of construction. We have been informed that the project will be completed within 2 years delay and payments have been deferred until they have reached the construction level equal to our payment amount. This is a relief. However, if the project is delayed BEYOND 2 years, we are entitled to a full refund by the developers according to our contract.
From the way things are going, UAE is beginning to look like a graveyard of skyscrapers. Who will live in these 100s of towers ? who will now come to the UAE, especially Ajman ? I am hoping and praying that the project gets delayed beyond 2 years and i can recover the money paid ....AMEN
