ARRA assured me Star Giga can't do this without their approval. I suggest you submit a complaint about this to ARRA as soon as possible. You can use my complaint as a guidline, see below. Three pages were attached. Give it a try!

Complaint against Star Giga Establishment Limited
Dear Ms Aysha,
I wish to make a complaint against Star Giga Establishment Limited for sending me a final notice of overdue account and threatening to initiate proceedings to terminate the contract.
Please note the points listed below.
• Star Giga have defaulted on the Completion Date of 31st July 2009.
• They have defaulted on the Longstop Date of 31st Jan 2010.
• The Ultimate Longstop Date of 30th April 2010 is very near.
• The seller blames delay on Force Majeure.
• The buyer has also been affected by Force Majeure as the economic crisis has affected everyone.
• (See Agreement of Sale, paragraph 16.1. page 10.) If the completion date is delayed by a period of more than two years, then the Buyer may elect to terminate this Agreement…….and the Seller shall refund all monies paid by the Buyer. (The two-year delay will be reached on 1st July 2011.)
• According to the contract the Buyer and I have signed, no more payments are due until handover, which has been delayed till 1st July 2012. (See attached payment plans)
• The buyer should be compensated due to the additional rent paid since 31st July 2009.
• Construction stopped in July 2008 and the Seller served notice in late Dec 17th 2008 and again in Feb 2009 that all due payments had been postponed due to the delay in obtaining the utilities and other infrastructure. These have still not been obtained nor has there been any progress on construction since July 2008, despite the Seller falsely claiming that the work is progressing on the site. As per all the points I have made above, I will make no more payments until the handover of the property, as per my original signed contract.

Final Notice of Overdue Amount:
Unit in Tower of Goldcrest Dreams - Emirates City, Ajman
Reference is made to our previous correspondences notifying you regarding outstanding amount towards the purchase of the property mentioned above.
We have noted that your account is in default and you have not made any payments in the recent past. You have till date paid only 38.2% of the unit purchase price. As you are well aware, the non-payment/delay in payment by the Unit Purchasers will abate the progress of any off-plan real estate projects. Our project is also behind schedule due to the non-payment/delay in payment by the Unit Purchasers and oppressive market conditions. Nevertheless, we have completed above 30% of the total project and the work is progressing in the site. The certificate of the project consultant is available on our support desk: http://crm.stargiga.ae/answer.aspx?aid=13192.
We are now constrained to issue this Final Notice of Overdue Amount since you have defaulted in making payments even after our previous demands/notices for payment.
You are hereby requested to make payment of the overdue amount of AED
within 30 days hereof, failing which we shall initiate proceedings to terminate the contract as per the ARRA guidelines (you may refer to the ARRA guidelines here: http://crm.stargiga.ae/answer.aspx?aid=13193) and forfeit all amounts paid towards damages. We also reserve our right to claim any further damages as per the prevailing laws.
A summary your account statement as per our records and the details of our escrow account details are enclosed herewith. If there is a reason why these payments have been withheld we would be obliged if you could contact us in order to either explain the reason or come to some form of payment arrangement.
Please disregard this letter in case you have already deposited the due payment in the project escrow account.
Please do not hesitate to contact our Customer Relations staff in case you need any further clarification with regards to the above issue.

If you like, I can send the table to your personal email. I'll copy it here, but it won't be so clear as it doesnt copy the lines of the table and it doesn't space it well.

I don't think we should panic at this stage, but we should lodge our compaints with ARRA as soon as possible.

Hi James, this is commendable, However I have emails from this specific point of contact at ARRA. She has not helped me in the past and my emails to her in English were responded to in Arabic and when translated, they amounted to little or nothing. I am not sure if she has much authority and of late she does not even respond to emails.

It is a valiant attempt nevertheless. I think everyone should complain.

By the way has anyone accessed Star Giga's question and complaint system on their new website. Have you noticed that they don't respond to your questions and the questions on their website appear to be their own questions and not that of investors. More like staged questions from a legal hand I suspect.

Are there any genuine Lawyers that can help?

I posted 3 questions on the star giga website and still no responses. The good thing is that they are logged so if they do not answer them at least you can do a print screen for evidence. I suggest you send all your complaints here and keep a copy of the print screen. They clearly have no intention of answering your queries.

Also one other important point. I raised a complaint previously with Arra sometime ago as Star Giga's precentage completion in their letters did not correlate with the percentage completion noted on Arra's website. Just after I raised this complaint I noticed that Arra changed the way they conveyed this info. Now they utilise these graphical type bars. What am I getting at? Well it was a rather convenient change wasn't it !!!

Arra is the problem, not the solution.. It is the stupid guideline of the payment being 30% more of the constrution % for projects which are more than 10% build. So Arra will not have any objections on goldcrest cancellations.....

As far as I am concerned, these percentage guidelines have no legal standing. All of us have only signed once and that was the contract, which included the original payment plan. We have never signed our agreement to anything else. Full stop! That means no more payments till handover!

moreover, just for my info, what happens if star giga stands another letter saying they have cancelled our contract

Lodging a complaint

Aysha Al Dhahri's email is either aysha.d@arra.ae or aysha.d@arra.com. I'd copy it to both. It might not do any good, but give it a try. If they get bombarded with complaints, maybe they might start to listen. I'd also make a file with a copy of your contract and your complaint and take it to the office. Make sure you get a complaint number.

Following that, send a copy of your complaint to Star Giga and tell them you've registered it with ARRA, who will be contacting them. Cc it to Aysha.

I think if a letter of cancellation comes from Star Giga, we should submit another complaint to ARRA. I think legal action would be far too costly.

How long since arra has been created? What have they done to protect investors rights? Now it is difficult to believe that they will protect us as investors in Ajman.But we should complain to ARRA as much as possible maybe they will wake and wake up the government.

I will visit Star Gigas

I will visit Star Gigas office in the coming weeks. I do this once in a while and it has become actually quite entertaining. I have integrated the loss of my money into my life and it does not "hurt" anymore, so to listen to their "bullshit" is just great fun. It is amusing what kind of excuses, predictions etc. they keep coming up with. I have told one of their representatives long ago: "Look into my eyes and listen: this project will never and I mean never be finished!" At the time I got an awkward smile from the guy, no other reply.
Sooner or later this office will close of course and then we all know for certain: Game over!

Star Giga & ARRA

I agree with Josau that this project is never gonna built and game is going to over soon. The Star Giga and ARRA are nothing but BullShit.
I also visited ARRA's office last week and registered a comlaint, however as per Ms. Ayesha this does not add value to any thing. The ultimate way to get your money back is through legal court which of-course is expensive too.

This is a complete loss and book it into your accounting books.........

Haji Sahib of Star Giga, You being muslim knows that poor people when ask from his Allah specially a daughter( whose father earned/saved this amount after 32 years) Allah never truned that Duaa and qaboolyat is there.
Please I know you are a good muslim and have God fear in your heart.
My father met with your Junaid alongwith Shafqat of ADCB while got loan from ADCB .

You people are investing and making progress in India and completing their projects speedily.This is our money from which they completing projects in third country and God is their they should not forget and God will close their throat which resulted nothing will go inside to cover their hunger.
Afraid from that time nothing will help them amd better get forgivness from God and retrun investor money without wasting a day.May God will give then peaceful life/death. This is true and donot take it easy as God saying is 100 % irrevocable & will not be declined.
This amount my father saved after 32 years and now he depends on his children as nothing left after retriment.
It was his dream to give her daughter a little assets of his life.

dear all, im also another victim of these crooks! i invested in goldcrest dreams. i just spoke to a friend of mine who work in gulf news earlier and now running his own business. he told me no one (news paper or tv) will have the guts to publish this matter as this will be against the shiekhs!!!, but he also told me since we are about 850 memebers here in uae, to go to the land department who is the top of all and can do something!
