as per the standard term and condition of your construction agreement any dispute arise between the parities (investor & developer) shall be settled through arbitration, therefore all no cases of breach of contract or claming compensation is going to be accepted by court of law the party shall follow arbitration procedure as per the laws of UAE, for criminal cases the matter is different but it would be quite difficult to proof criminal responsibility against developers.

Many investots did a poilice calim against Mr.Aman Quraishe, because he is already in jail for a criminal charge(fraud), theres a big chance to get your money back from him, the construction is not statretd yet which should the building be ready in november this year, and the developer(Aman quraishe)never respond to the investors, the project Lake view is not registered with arra yet, therefore it is a big chance to get your money back from him..even with interest...

Arbitration/Going to Court?
Mahateer has made a point about arbitration suggesting that the court will not accept cases filed against developers for breach of contract. I don't think this is correct.
There is a standard clause re: arbitration in most contracts but please note, this is in relation to the 'Property Management Agreement' which is one of the schedules to the main contract. The 'Sale and Purchase Agreement' has a clause stating that 'any legal action or proceeding with respect to this Agreement shall be subject to the jurisdiction of the Courts of Ajman, United Arab Emirates'.
Of course you are quite entitled if you so wish, to take legal proceedings against a developer who has breached their contract or failed to abide by the 'Governing Law and Jurisdiction', eg, has not put your money in an Escrow Account!
Procedure for going to court? First get a letter from ARRA stating your developer and/or the project has not been registered (take your contract and ID to get this). Then get the contract translated into Arabic (expensive!) - take this plus your contract, ID, and all receipts for money already paid to the court in Ajman where the typing section will prepare the necessary documentation (for a relevant fee). This is how you start a private petition against someone without the use of a lawyer.

there are already 700 cases pending against Alrashed not a single decided. Should I go to court putting another aed 150000 appx for apartments of my family members who are 5 or wait for arra dispute settlement body? Alrashed has runaway with my hard earned money and no law for investors. Plzzzzzz advise.

try asking the same letter from ARRA for R holding project EYE tower which has no escrow and not on approved list after launch since 2 years. they just dont care. ARRA support my foot.

Have a look at this article from Business 24-7. This is a Q&A with 5 Lawyers, and looks at
1) Filing cases against a developer that claims to be bankrupt (or probably even run away with no assets behind).
2) Also addresses the issue of Class Action - ie multiple investors filing cases against the same developer. Makes no difference, other than if one is lucky, all cases may be heard by the same court/judge...otherwise, there is no concept of class/group action. So, if the developer screws 1 of us, or 100s of investors... same difference to them. I suppose that's why they do this on a large scale.
Nothing new in the article by the way - the investor continues to get shafted, with minimal rights - by both system and perpetrator.

How much would appr. the cost for file a case? What are the steps?
Aed-50,000/= (US$-13500/=) Minimum for any Case
To file a case in court, court charges 5 to 7% of the claim value or Aed-30,000/= whichever is lesser, plus Typing, legal translation, Lawyer etc ends up to minimum cost of Aed-50,000/= can be much higher if you are taking a good lawyer who will actually work out on case, as normal lawyers who charge less than Aed-25000/= are actually not working on cases seriosuly.
I know some one who win the case against ACI who sold full floors in Humaid City for Al Rashed. Claim was Aed-3 Million as investor purchased the floor on cash in discounted prices. So it was worth doing case.
Now after winning case after about 8 months and spending around Aed-300,000/- ACI went for appeal in Abu Dhabi. Means another one year or half and then execution of Claim if ACI loosed the case in appeal. The amount is big enough to take all these hassels and expenses can be afford. Total proceedure according to Lawyer is of around 2 and half years.
If any body has better information please share or if I am wrong somewhere, please correct me.

Why do you need an expensive lawyer to stand up in court for you having barely read the details of your case? If your case is simple, eg the developer and/or the project is not registered therefore no Escrow, surely you can go to court and represent yourself. Representing yourself will save a lot of money. Also, several people coming together to pay for the translation of the project's contract will save money.
By the way, even if the total legal fees amount to AED 30,000 as suggested, its still worth it for someone whose investment is as low as AED300,000 - 10% approx is a good deal less than the 30-40% drop in the value of property in Ajman lately. Of course, if you are in this for the long term - don't mind waiting 2 more years for completion if your lucky, don't mind waiting for utilities, don't mind living in a 'city' with no facilities, no views, no completed roads, other buildings still being constructed around you, then fine - sit back and wait!

the primary reason
the primary reason arbitration is used in civil/commercial contracts is that it is alot cheaper then going through courts.
hence in most commercial contracts, arbitration is called for, where the costs of case in arbitrations sometimes are 80/90% cheaper then going to court.
the outcome/judgement would generally be same if went to court, however difference is all the legal preliminary procedures are cut out, and the direct issues at hand ate addressed, which then saves costs.
going arbitration does not mean investors or developers are worse off, it is simply gone through that root as it is cheaper.
only where there is a complex area of law, or where a judicial precedent is sought, to give authority for others on an issue, are their merits to spend the substantial higher sums to go to court instead of arbitration
