Essentially, what you can do legally - depends on the protection that is written into your contract. Read that carefully. If there is nothing in your contract - your options are very limited to some hard choices.

For example, in my case, I have paid around 35% (~350K AED), with no construction activity - except for sand being moved around from one side to the other. At the current rate, the developer would have cashed all cheques, and legally, doesn't need to provide me with anything... until 2012.... by when he has to give me the unit, or refund the money with a small interest payment. That too only because it is in my contract. The other option is to default and loose 50% of amounts paid.

If you have Post Dated Cheques issued, you cannot walkaway, without legal assistance.
If you are just wire transferring payments in, you can at least consider stopping - without any legal problems.

If you need the name and address of a Dubai Law firm, please send me a PM. I haven't done any business with them, but my interactions so far, seem good. They also will hear your problem, and decide if they can do anything - no charges unless you decide to go ahead. Having said that, given that we're all burnt by the developer's - make sure you don't repeat it a second time with the lawyers. You will find lawyers that charge initial consultation to hear the problem, only to tell you things you already knew.

I am in the same situation, I have bought a 2br in music tower, paid already 30%.
I am also thinking of initiating a lawsuit because nothing is happening on the site and
i don't know why they need our money if no one is working and no construction materials is to be paid.

So if anybody is interested to join me and a friend in this action, I think the more we are, the most
efficient our action will be.

I also have a 2 B/R in Music Tower, paid 30% and definitely will not keep on paying for nothing especially that:

- They haven't started the works yet (not sure they even have the land department approval ...)
- Only 40% of the flats are sold (who would buy the remaining 60% ?!)
- Among these 40% I guess half will stop paying ... then actually only 20% keep paying ...
- Consequently no sufficient financing to pursue the project !

The BEST solution for EVERYONE including Developper is to STOP it right now and refund the money.

- Now they are claiming to start in Q1 2009.
- Different news , Developer claims that 60% of the units have been sold , but evidences showed that this number is around 40% or less
- Choclate tower which has been launched and started by far before Musich Tower doesn't seem to be progressed.
- Unfortunately our right due to this very unfair contract from developer is very limited. No escrew account and payment based on progress. Moreover no gurranty.

I believe our best choice is to file law suit against them. The more we are the higher will be our voice. if you also want to rescue your capital , help me to shape this community to move together , we are all in the same boat. My email address is

No one is coming forward from the main devleoper or this developer to tell us what is going on. those who are affected need to get togther and figure out something to understand the situation. we have asked to meet the manager, any one in the company who is in charge, and we could not. we met just some girls in the office and no firm information. are we going to lose our money? i know i m not the only person. we should pay once we know firmly that the construaction is started. the devleoper must invite all investors to dubai and give presention on his view and plans if this is a real business otherwise, we need to get togther and file a case. i will be around this forum to hear you all.

I was in Dubai last week and went to the Al Andaleeb office. They told me that because of financial crisis they were afraid of giving the construction work to anybody and that they were searching for a really serious company. They should start working on the site on February.
Of course there is no assurance on that.. They looked quite serious when they were talking that financial crisis does not affect them as they work with our cash.. We need somebody from Dubai with more information to advise us..
What are our chances to get the money back if the project fails??

I have 2 BR in money tower and payed 50% of it.I am worry about andaleeb. today I sent a compliant to ARRA. (Ajman Real-Estate Regulatory Agency)
They have called Al Andaleeb (GM) to several meetings. They have requested that they provide an ESCROW account and registration. On several occasions ARRA has told the GM to provide these documents and they have failed to do so.
Contact ARRA asap. Contact is Latifa Al Nuaimi 06 7444 144. For those of you that are not in the country her email address is latifa.n@arra.ae. You need to tell ARRA about your situation and what you require. It is important that you ask all the questions you need to ask and to confirm all that is listed above.

I would recommend that you all contact ARRA and log your complaints also cease your payments immediately if your developer doesn't have an ESCROW account.
I'm a journalist with a special interest in Ajman as I too have purchased a property there. It is a worrying time but from what I have been able to find out ARRA and Ajman need these developments to work out. They have more money riding on it than we do.
For those of you who do not live in the U.A.E I write a column and can try to help you find out the information that you need. I understand that telephone conversations are not a strong point in this part of the world. Al Andaleeb will tell you we submited our docouments but the delay is from ARRA.
you will ask them about an account Number they will never provide you with one.

if you are having really a bad luck someone called Yalane will answer your call and for sure she will use her Zero customers service skills to make you feel like nothing on top she will ask you to call in two weeks times as usual.

-you need to get a docoument from ARRA clearly stating that Al andaleeb didnt open an Escrew account.and didnt comply with ARRA regulations.

-then along with your contract you need to report this case of fraud to the police.

-we can pool together for the lawyer fee but court fees are fixed at 7% of your investment per person.

however we need to gather together all of us get this docoument as indviduals from ARRA and forward this to Al Andaleeb, and police,Media ...as another form of pressure may be we can get any thing from our money.
same like what happened with those investors in Frankfurt tower.
remember that Al Andaleeb sold three towers and chocolate was the first one.

Just a quick update, I have got a letter from ARRA dated 14th July stating that Al Andaleeb didn’t open the Escrow account till date.

I have some concerns regarding a comment has been added to that which is ‘Al Andaleeb are not approved by ARRA to commence building any project till they submit all the required documents and open the escrow account

ARRA has confirmed that the dead line date was 1st of July and ARRA confirmed that no extension has been giving to al andaleeb after that date. Hence I don’t understand why they have added the comment of till they submit all the documents!!!

any way ,I suggest that we who are all involved with Al Andaleeb and not getting anything tangible should come together, and meet up...
Let’s set up a contact date and meet up. If we can all go to Al Andaleeb office, ARRA, police, Lawyers, we can do that as well as a group.
this will have a greater effect.
It is better that we gather as a force and achieve our objectives than to approach them one by one and walk away with their Bull xxxxxxx.
If we are successful, then we set an example for others to follow, and probably bring some sanity into the system.

i am from Saudi Arabia and i to have invested in the Money Tower. I had just made a call three weeks to ARRA. After much trying, i finally got in touch with a contact! He said An Daleeb are in trouble with the government and they are not showing themselves in court!

Looks like we need to hire a lawyer! A friend of mine suggested (he also hired a lawyer) to me to find people in the same project and that we all go to lawyer and battle this together as a group rather than alone.

I live in South Africa and I invested in a 2bedroom Money Tower apartment.
since feb 09 until dec 09 i have flown from south africa to the uae in concern regarding the project.
over the telephone and even visiting in person, i get the run a round.
1st andaleeb was waiting for escro account.
when i spoke to the sales person he informed me that construction had started, only to find out developers have only done soil testing to date.
in 2009 i have visited andaleeb 5 times and every time they have a different story.
they were very quick to accept our money, since they claim to have our funds in their old account i honestly think they should refund it.

I will give you inside out of what is going on . Law sues won't work. No use paying for something that will not post a solution.

Solution is not easy. But it will not cost you also.

Just for your information electricity and water will not touch ajman - Emirates City for a long time as planned. All developers knew it but no one talked abt it . So if the hand over was in 2013 .. just wait till 2015 than is the time it could happen.

I know you all would be saying so what , we have paid all this. Well its not the end of the world. There are ways.

Individually nothing is going to happen.
